Choosing a name...

Choosing a company name requires a check to ensure that the company name is not already registered. There is also a list of words which you are unable to use without approval from ASIC.

The ASIC National Names Index is a public register which you can search online (
click here) to check whether your chosen name is already registered.

Words which require approval from ASIC include: "building society", "trust", "university", "chamber of commerce", and "chartered". Additionally words which suggest a connection with Government are unable to be used, such as "Royal Family" or "ministry of".

These restrictions ensure that your company name does not mislead people about the activities or association of the company. ASIC also has a general discretion to refuse to register certain names if they are offensive or suggestive of illegal activities.

You should also ensure that your chosen name is not similar to any registered or pending trademarks. You can check the database held by IP Australia for this.
